The terms below govern your access to and use of faktorikgroup.com and the online services connected to it. By opening or using the site you agree to be bound by them, so please read them before going further.

Acceptance of these terms

Every time you access the site you confirm that you have read these Terms of Use and our Privacy Policy, and that you agree to comply with both and to be bound by them. If you do not accept them, please do not use the site.

Information on this site is not insurance

The descriptions of cover, the savings calculator, the worked examples, and every other page on this site are provided for general information. None of it constitutes a quotation or a binder, nor an offer to insure any particular shipment or business. Cover comes into existence only when underwriting has been completed and a policy issued, and that policy alone, with its wording, conditions, exclusions, and endorsements, determines what is insured.

Intellectual property

The text, graphics, logos, icons, photographs, audio and video material, data compilations, and software on this site are the property of Faktorik Group or its licensors and are protected by copyright and other intellectual-property laws.

The material is published for your information. Except for viewing it for your own non-commercial purposes, or as otherwise permitted by law, you may not copy, distribute, adapt, or reuse any part of it without our prior written consent.

Acceptable use

In using this site you agree that you will not:

• Upload, post, or transmit material that infringes any person’s intellectual-property, privacy, publicity, or other rights.
• Distribute content through the site that is unlawful, defamatory, obscene, or otherwise objectionable.

Your obligations as a policyholder

If you purchase or bind a policy through Faktorik Group, you additionally agree to:

1. Comply with the coverage rules: the conditions, limits, exclusions, and documentation requirements communicated at sign-up and set out in your policy documents and claims procedure.
2. Read your policy: you are responsible for understanding the terms that apply to your goods, routes, commodities, and trading activities, including any river, rail, road, or ocean legs.
3. Stay current: coverage rules and programme guidelines may change. We notify material changes on the site or through your broker, or by using the contact details we hold for you.
4. Tell us what changes: inform us promptly of changes to your shipping profile, values, commodities, or anything else that could affect cover or premium.
5. Follow the claims process: submit claims with the required documentation within the stated time limits. Missing a step may affect the outcome.

Our obligations to you

As your cargo and shipping insurer, Faktorik Group undertakes to:

1. Act within the law: conducting business in accordance with applicable insurance legislation and regulation, including fair claims handling and statutory record keeping.
2. Protect your information: maintaining reasonable safeguards against unauthorised access to, alteration of, or disclosure of client information, as described in our Privacy Policy.
3. Retain records responsibly: keeping records for the periods required by law and industry practice, then deleting or anonymising them once retention is no longer necessary.
4. Communicate plainly: providing, wherever practicable, clear information about programmes, the material terms of cover, and any changes that may affect your policy.

Third-party websites and tools

The site may link to third-party websites, carrier tracking tools, or partner platforms. These are operated by others. We have no control over their content, privacy practices, or availability, and your use of them is governed by their own terms.

Disclaimer of warranties

The site and its content are provided “as is” and “as available.” To the fullest extent permitted by law, we disclaim all warranties, including those of merchantability, fitness for a particular purpose, title, and non-infringement, and we do not warrant that the site will operate without interruption or error or that it will be free of harmful components.

Limitation of liability

To the extent permitted by law, Faktorik Group and its affiliates, officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of this website. For direct damages connected with use of the site, our total liability is limited to the greater of the amount you paid us for online services in the twelve months preceding the claim or one hundred U.S. dollars, except where the law does not permit liability to be limited.

Indemnity

You agree to indemnify and hold harmless Faktorik Group against claims, losses, damages, and expenses, including reasonable attorneys’ fees, arising from your breach of these terms or your misuse of the site, except to the extent caused by our own gross negligence or wilful misconduct.

Governing law

These terms are governed by the laws of the State of Oregon, United States, without regard to its conflict-of-law principles. Where mandatory local law applies to an insurance contract you hold with a company in the group, that law governs the contract.

Amendments

We may revise these terms at any time. Updated terms are published on this page and take effect when posted, so please check back periodically.
